Jiah Khan case : High Court refused to extend stay on trial against Sooraj Pancholi

Bombay HC refuses to extend stay on trial against Sooraj Pancholi. The High Court on February 24 stayed trial against Sooraj while hearing a petition filed by Jiah’s mother Rabia Khan challenging the investigating agency CBI’s charge sheet terming Jiah’s death as a suicide. Rabia Khan filed an petition against Agency CBI for telling Jiah's death as suicide. Rabia sought the High Court to set up a Special Investigation Team (SIT) to start the case from fresh. When the petition came up for hearing today before a division bench of justices N.H. Patil and A.M. Badar, Rabia’s lawyer Subash Jha sought for the stay to be extended pending hearing of this petition. However, Bench denied to to extend the stay and Rabia’s petition for hearing on June 7. Patil Said, 'Rabia was not happy with the police investigation and approached the high court which directed CBI to probe the case. CBI filed it's charge sheet and came up with the same decision like police and charged the accused under section 306 (Actuate for Suicide). Now Rabia want SIT to investigate. What if tomorrow your are not satisfied with the SIT also? This has to end somewhere.' Lower court has to confirmed the allegation against Sooraj Pancholi on 5th May. CBI counsel Hiten Venegaonkar today told HC that the agency was planning to file a petition challenging the government’s notification appointing a special public prosecutor in the case.
